The Difference Between a DWI and DWAI
Under New York Law, people accused of being drunk or intoxicated behind the wheel can be accused of either DWAI or DWI.
DWAI:
- Caused by having a .05 to .07 BAC, or having visible impairment.
- Typically considered a misdemeanor offense.
- First time offenders may suffer a 90 day license suspension, up to 15 days in jail, and up to a $500 fine.
- Penalties get more severe for repeat offenses.
DWI:
- Caused by having a .08 BAC or higher, or other evidence of intoxication.
- Generally considered a felony offense.
- First time offenders typically face up to $1000 in fines, up to a year in jail, and a six month or longer revocation of their license.
- Aggravating circumstances (very high BAC, having a child in the car, repeat offenses) can make consequences more severe.
