  2. Personal Injury Protection (PIP): TLC also requires ride-sharing vehicles to carry $200,000 in PIP No-Fault coverage, ensuring adequate protection for medical expenses passengers may incur in case of injuries.

SUM Insurance: Unfortunately, Supplementary Uninsured/Underinsured Motorist (SUM) coverage, which provides additional protection if you’re injured by an uninsured or underinsured driver, is not mandated for Uber, Lyft or for-hire vehicles operating within NYC. This exemption stems from VTL §1693(12), leaving passengers and others potentially vulnerable in certain scenarios.

Excess Insurance: While Uber claims to have a $1 million excess policy for its drivers in NYC, the company often asserts that its drivers are independent contractors, distancing itself from liability in negligence cases. The independent contractor defense may make it difficult for an injured passenger or pedestrian to recover against Uber when a negligent Uber driver causes injury.

Ride-Share Insurance Coverage Outside NYC:

In contrast, regulations outside NYC, as governed by Article 44-B of the NY Vehicle and Traffic Law, provide a different landscape for ride-sharing insurance:

  1. Offline or Driver App Off: When a driver is not using the ride-sharing app, their personal auto insurance applies. In New York State minimal liability coverage of $25,000 per person and $50,000 per accident is all that is required.
  2. Waiting for a Ride Request: When a driver is using their Ride-Share app and waiting for a ride request, State Law requires the following coverage:
    • $75,000 per person and $150,000 per accident, liability coverage
    • $50,000 per person PIP No Fault coverage
    • $25,000 property damage coverage
    • Uninsured/Underinsured Coverage
      1. $25,000/$50,000 bodily injury per person/per accident
      2. $50,000/$100,000 death per person/per accident
  3. En Route to Pick Up Riders and During Trips: Once a driver accepts a ride request and is en route or during the trip, required insurance coverage significantly increases to ensure comprehensive protection for both passengers, pedestrians and drivers.
    • $1,250,000 third-party liability coverage.
    • $1,250,000 uninsured/underinsured motorist bodily injury coverage.
    • $50,000 Personal Injury Protection per person.
    • Contingent comprehensive and collision coverage, covering the actual cash value of the car with a deductible.

Implications:

If you are a passenger, pedestrian or another motorist injured in a crash due to the negligence of an Uber/Lyft driver in NYC the insurance coverage available to compensate you for your injuries is significantly less than the insurance coverage available to you when the crash takes place in Nasau or Suffolk County or any other part of New York State outside of NYC.

As an example, consider an Uber passenger in NYC who is seriously injured when the driver runs a red light causing a crash. The passenger requires surgery and loses months from work. The maximum recovery for that passenger is capped at $100,000. If the crash takes place anywhere outside of NYC the passenger could recover up to $1,250,000.

If the NYC Uber passenger had Supplementary Underinsured Motorist Coverage on their own personal vehicle in excess of $100,000, they could get additional compensation from their own insurance up to the maximum limits of their policy.
